Welcome to Frisson, a social network designed for music discovery and discussion. These Terms of Use ("Terms") govern your access to and use of Frisson. By creating an account or accessing the App, you agree Terms. If you do not agree, you may not use the App.

1. About the App and Eligibility

Frisson is a community platform for music enthusiasts to share reviews, curate playlists, and discover concerts. The App does not support music streaming or downloading but integrates with third-party services like Spotify and Ticketmaster for enhanced functionality.

The App is intended for users aged 16 and older. If you are under 16, you must have permission from a parent or guardian to use the App. Users under 13 are strictly prohibited from accessing the App in compliance with the Children’s Online Privacy Protection Act (COPPA).

By registering, you affirm that you are eligible to use the App and agree to these Terms.

2. Account Creation and User Responsibilities

To access certain features, you must create an account and provide accurate information, including your name, email address, and date of birth. This information helps us personalize your experience and ensure the App’s functionality.

You are responsible for maintaining the confidentiality of your login credentials. Any activity on your account is your responsibility. If you suspect unauthorized access, you must notify us immediately at support@frisson.fm.

Misuse of the App, including providing false information or engaging in prohibited activities, may result in suspension or termination of your account.

3. Acceptable Use of the App

The App is designed to foster a positive and collaborative environment for music lovers. By using the App, you agree to the following:

  • Respectful Interactions: You will not post content that is harmful, harassing, defamatory, or otherwise violates the rights of others.
  • Prohibited Activities: You will not use the App for commercial purposes without prior authorization, upload malicious software, or interfere with its operation.
  • Compliance with Laws: Your use of the App must adhere to all applicable laws and regulations.

Failure to comply with these guidelines may result in the removal of your content or termination of your access.

4. User-Generated Content

The App encourages users to share their opinions through reviews, playlists, and other content. When you post content, you retain ownership but grant Frisson a non-exclusive, royalty-free license to use, modify, and display your content within the App.

While we do not actively monitor all user-generated content, we reserve the right to review and remove content that violates these Terms or applicable laws. Users are responsible for ensuring that their content does not infringe on third-party rights.

5. Third-Party Integrations and Location Services

Frisson integrates with third-party services, such as Spotify and Ticketmaster, to enhance your experience. We do not control or assume responsibility for the actions or content provided by these services.

Additionally, if you enable location services, the App will collect and use your geolocation data to provide nearby concert recommendations. You can manage these permissions through your device settings.

6. Intellectual Property

All trademarks, logos, and content within the App—excluding user-generated content—are owned by Frisson or its licensors. These materials may not be copied, modified, or redistributed without our express written consent.

Unauthorized use of our intellectual property may result in legal action.

7. Disclaimers and Limitations of Liability

The App is provided "as is" without warranties of any kind. While we strive to ensure a reliable and enjoyable experience, we do not guarantee uninterrupted service, accuracy, or compatibility with all devices.

To the fullest extent permitted by law, Frisson is not liable for any damages arising from your use of the App, including data loss, service interruptions, or technical issues.

8. Privacy and Data Collection

Your use of the App is subject to our Privacy Policy (frisson.fm), which explains how we collect, use, and protect your personal data. By using the App, you consent to these practices.

9. Changes to the Terms

We may update these Terms periodically to reflect changes in our services or legal requirements. If significant updates are made, we will notify you through the App or via email. Continued use of the App after updates constitutes your acceptance of the revised Terms.

10. Dispute Resolution

In the event of a dispute, you agree to resolve it through binding arbitration under the rules of the American Arbitration Association (AAA). Arbitration will take place in Pennsylvania, and you waive the right to participate in a class action.

These Terms are governed by the laws of the State of Pennsylvania.

11. Termination

We reserve the right to terminate or suspend your account at our discretion if you violate these Terms. Upon termination, your access to the App will cease immediately.
